A scooter operator is dead and a BMW driver was in police custody Saturday following an early morning crash in Queens, police said.

The victim on the scooter was zipping past the corner of 37th Ave. and 82nd St. in Jackson Heights about 1:15 a.m. when he slammed into the passing BMW, cops said.

EMS rushed the victim to Elmhurst Hospital, where he died. Cops were trying to identify him Saturday.

It's believed that the scooter operator sparked the crash by disobeying a traffic signal as he entered the intersection, a police source with knowledge of the case said.

The man behind the wheel of the BMW remained at the scene, but was arrested on suspicion of drunk driving, police said.

Criminal charges were pending Saturday.
